Litigation FAQ

A personal injury claim is legal action seeking damages for emotional injuries, and/or property damage sustained as a result of another’s negligence.

Many factors will affect the length of your case.

The extent of your injuries – If your injuries are severe, you may not be able to make a claim right away. The Insurance company – While we have the best practices in place to get your case in motion as quickly as possible, we might need more time to do so due to the insurance company’s processes.

Gathering documents – Depending on your case’s complexity, it might take some time to gather certain documents.

The Injuries Board – Once all documentation has been collected, we will submit your case to the Injuries Board for evaluation. They have nine months to return to us with their assessment.

Assessment – After the Injuries Board has completed their assessment, you have 28 days to accept or reject it.

Legal Proceedings – If you reach this stage, your solicitor will immediately issue proceedings. Although your case may settle without you ever having to go to court, the length of the settlement meeting depends on the availability of barristers as well as the attendance of the other party.

Personal injury claims are a way to seek monetary compensation for injuries or illnesses caused by (or made worse by) someone else’s negligence. To make a personal injury claim viable, it has to fulfil some conditions. These may include the duty of care, breach of duty of care, causation, etc. Feel free to contact us for more details on personal injury claims.
